Covid-19: Suspension of Legal Times & Closure of Courts of Justice

Suspension re: Promise of Sale Agreements (konvenji) & Notarial Matters

  • Such order shall suspend the running of all the legal terms imposed on a notary public:
    • to register any deed, will, act, private writing.
    • any period to pay taxes collected by him.
    • any term related to fiscal benefits, incentives or exemptions.
    • to submit information or documents to any Authority or Regulator.
    • expiration term of Promise of Sale agreements.
  • Such order shall last 20 DAYS following the repeal of any such order by the Superintendent.

Suspension re: Legal & Judicial Times

  • Such order shall suspend:
    • the running of any legal and judicial times.
    • any other time limits – including peremptory periods applicable to proceedings/ other procedures before the Courts.
  • Suspension shall last 7 days following lifting of repeal.
  • Without prejudice to the power of any Court to open registry or to hear a case (both urgent cases and of public interest).

Closure of Courts of Justice

  • Closure of Courts of Justice:
    • superior/inferior/appellate
    • tribunals/boards/commissions/committees which operate from the building of the Courts of Justice including:
      • Industrial Tribunal
      • Employment Commission
      • Committee of Inquiry (Deprivation of Citizenship)
      • Partition of Inheritances Tribunal
      • Information and Data Protection Appeals Tribunal
  • Closure of the Court Registry, including all registries pertaining to any Court.
  • Closure of all Courts of Justice and Registry with effect from 16th March 2020

in force until revoked by Superintendent

  • Any legal, judicial or administrative time-limit for the filing of any acts before the Court following the conclusion of any proceedings before any Tribunal, board, commission, committee or other entity which does not operate from the building of the Courts of Justice

shall be suspended for a period of 20 DAYS from the lifting of the repeal of this order by the Superintendent

Closure of the Local Tribunals

  • The Superintendent ordered the closure of the local tribunals and the registry with effect from the 30th March, 2020.
  • This order shall remain in force until it is revoked by the Superintendent.
  • Any legal, judicial or administrative time-limit for the filing of any acts before the local tribunals shall be suspended for a period of 20 days from the lifting of the repeal of this order by the Superintendent.

Suspension of Legal times of Revenue Acts

Any legal time, including prescription periods and peremptory periods, referred to in the following list shall be suspended with effect from the 3rd April 2020:

  • the making by the Commissioner for Revenue of any assessment, demand for payment, request for information, decision or order, and the issue and service of any notice thereof
  • the payment by the Commissioner for Revenue of any refund of tax
  • the institution, execution or continuation of any judicial action for the collection of tax, additional tax, administrative penalty or interest, or for the prosecution or request for the prosecution of any criminal offence

This means that any  legal  time  to  which  this  article  applies,  that commenced running before the suspension has come into force but has not expired before that date, shall be suspended and shall continue running again for the period remaining as at that date, as from the date that the suspension does not remain in force.

Any legal time to which this article applies that, were it not for this order, would commence running while the suspension is in force, shall commence running as from the date that the suspension does not remain in force.
